Attorneys for former President Donald Trump are requesting that the sentencing for his recent conviction on felony charges of falsifying business records be postponed until after the upcoming election. They argue that delaying the sentencing will reduce concerns about the integrity of the proceedings, especially given the importance of the election to the nation. Trump was convicted in May related to a hush money payment to Stormy Daniels during the 2016 election. The initial sentencing date was set for July 11 but was postponed to September 18 to allow time for arguments based on a U.S. Supreme Court decision on presidential immunity. However, the judge has repeatedly denied requests for recusal and is moving forward with the case. The attorneys argue that a short period between the immunity decision and the sentencing date would not allow enough time for a proper appeal. They also claim that allowing the district attorney’s office to submit its sentencing recommendation during this period could be prejudicial to Trump and the institution of the presidency. Trump’s attorneys have raised conflict allegations against the judge, pointing to his daughter’s work on digital fundraising for Kamala Harris’ 2020 campaign. The judge has issued a partial gag order preventing Trump from publicly criticizing his daughter and others involved in the case. Trump has appealed the gag order and continues to express concerns about the fairness of the proceedings, suggesting that the U.S. Supreme Court may need to intervene.
