Lawyers for former President Donald Trump are objecting to special counsel Jack Smith’s plans to file an oversized brief in his 2020 election interference case. They argue that this could improperly impact the 2024 White House race. Trump’s defense attorneys believe that such a filing would be like a premature and biased report from the Special Counsel’s Office.
Prosecutors from Smith’s office argue that filing an oversized brief is necessary to address Supreme Court concerns about presidential immunity issues in the case while limiting the number of possible appeals. They have asked the judge overseeing the case to allow them to file a 180-page brief by Thursday.
Trump’s lawyers are urging the judge to reject this proposal, calling it a “monstrosity” and an attempt to air biased grievances. They believe it could impact the 2024 Presidential election and do not want criminal procedures to be manipulated for this purpose.
Trump is facing charges related to his efforts to overturn the results of the 2020 election, to which he has pleaded not guilty. The trial was initially scheduled for March but was delayed after the Supreme Court ruled that some of his actions were protected by immunity. The case now hinges on whether his other actions were official or unofficial acts, and no trial date has been set yet.
