Lawsuit Filed by Oregon and 13 Other States Questions Elon Musk’s Access to Classified Data


Attorneys general from 14 states have filed a lawsuit challenging the authority of Elon Musk and his Department of Government Efficiency (DOGE) to access sensitive government data. The lawsuit, filed in federal court in Washington, D.C., alleges that Musk’s actions can only be taken by a nominated and Senate-confirmed official, citing constitutional provisions. The attorneys general seek to bar Musk from issuing orders to the executive branch outside of DOGE and declare his actions as having no legal effect.

Oregon Attorney General Dan Rayfield stated that Musk’s power grab puts people’s privacy and security at risk and disrupts systems that keep the country running. The attorneys general are requesting the court to order Musk to identify any data obtained unlawfully, destroy unauthorized access, and prevent him from making changes to government disbursements and contracts.

Michigan Attorney General Dana Nessel, along with attorneys general from Arizona and New Mexico, are seeking to invalidate Musk’s directives and actions while issuing a restraining order. Attorneys general from California, Connecticut, Hawaii, Maryland, Massachusetts, Minnesota, Nevada, Rhode Island, Vermont, and Washington have also joined the lawsuit.

Musk has been criticized for his approach to cutting government spending and restructuring priorities, calling for the deletion of entire agencies from the federal government. Democratic attorneys general have raised concerns about the handling of sensitive information at agencies, such as the CDC and IRS. The lawsuit alleges that Musk and DOGE are violating the law, prompting calls for a restraining order against his actions.
