Oregon bill proposing granting judges the authority to decriminalize drug possession and other offenses does not move forward

A bill that aimed to give judges the discretion to treat certain misdemeanor offenses as violations punishable by fines rather than crimes has died in committee this week. House Bill 2469 faced opposition from prosecutors who argued that it would decriminalize a long list of crimes, including drug possession, shoplifting, hate crimes, and public sex acts. The bill would have allowed judges to consider the character and criminal history of defendants in deciding whether to downgrade a misdemeanor to a violation.

The bill was seen as a top priority by defense attorneys, who hoped it would alleviate demand for public defenders by reducing the need for court-appointed attorneys. Lobbyists for the Oregon Criminal Defense Lawyers Association believed that the bill could benefit a wide range of defendants, preventing unnecessary delays in assigning public defenders and avoiding criminal records for minor offenses.

Despite gaining vocal support from Rep. Jason Kropf, the bill was removed from consideration for a vote at the last minute. The failure of the bill marks a significant defeat for defense attorneys, who had negotiated for months to make the bill more acceptable to prosecutors. Critics of the bill feared it could undermine recent reforms to drug possession laws in Oregon.

While the bill did not pass, proponents argue that it could have allowed judges to consider the circumstances of each case and make more appropriate rulings, potentially reducing the burden on the criminal justice system. Lawmakers and advocates will likely continue to debate the appropriate balance between decriminalizing minor offenses and maintaining public safety in future legislative sessions.
