Oregon Courts Prepare for Possible Immigration Enforcement Amid Concerns Following Judge’s Arrest

In light of a recent incident involving a Wisconsin judge who was arrested for allegedly aiding an immigrant in evading federal agents, officials in Oregon are exploring options to guide local courts on how to address potential immigration enforcement actions. While no confirmed immigration arrests have been reported at Oregon courthouses since the Trump administration took office, state officials are keen to ensure compliance with Oregon’s laws, which generally prohibit cooperation with immigration enforcement.

The Oregon Judicial Department is currently examining guidance options, although no decisions have been finalized, according to spokesperson Todd Sprague. He emphasized the importance of an independent judiciary free from intimidation, crucial to upholding justice.

The Trump administration had revoked protections for courthouses in January 2021, allowing for arrests without prior approval. This change has reignited fears in sanctuary states like Oregon. Following past controversies, Oregon’s former chief justice had previously issued guidelines limiting immigration arrests in courthouses, which were rescinded after lawmakers bolstered sanctuary laws.

Individual courthouses are now taking proactive measures. Richard E. Moellmer, trial court administrator for the Washington County Circuit Court, has instructed staff not to assist immigration agents unless they present a judicial warrant. Meanwhile, Multnomah County Circuit Court’s Presiding Judge Judith Matarazzo stated that while there have been no reported incidents, she remains committed to upholding safety in the courthouse environment.

The Multnomah County Sheriff’s Office reiterated its policy of not enforcing federal immigration laws, emphasizing the importance of community trust and safety. With ongoing uncertainty due to the political climate, Oregon courts continue to seek guidance on navigating the complex intersection of state and federal laws regarding immigration enforcement.
