DOJ Launches Title IX Investigations into Oregon and California Sports Policies

The Department of Justice (DOJ) announced on Wednesday that it is investigating Oregon and California for potential violations of Title IX, following complaints about male athletes competing in female sports. The initiative aims to uphold the protections intended for female athletes under this law, designed to ensure gender equity in education and sports.

In a letter from Assistant Attorney General Harmeet Dillon, the DOJ confirmed a thorough examination of the Oregon Department of Education and the Oregon School Activities Association (OSAA). The investigation was prompted by numerous complaints from female high school athletes who argue that allowing males to compete in girls’ events undermines their opportunity to compete fairly. The letter emphasizes that such practices effectively negate the protections provided by Title IX, stating, “When males are allowed to compete with girls… the law is broken.”

This inquiry aligns with broader efforts following a 2020 executive order under President Trump intended to strengthen Title IX protections. Despite federal directives, both Oregon and California have enacted policies allowing transgender athletes to participate based on gender identity rather than biological sex.

California’s scrutiny stems from a 2013 law permitting transgender student-athletes to compete according to their gender identity. The DOJ’s current investigation arises amid public outrage over a case involving a male athlete qualifying for girls’ cross-country championships, leading to threats from Trump regarding potential cuts to federal funding.

The DOJ’s commitment to ensuring equal athletic opportunities under Title IX reflects a significant legal and social debate regarding gender identity in sports, underscoring concerns about fairness and competitive integrity for female athletes across the nation.
