Oregon lawmakers are currently considering a bill, Senate Bill 599, that would make it illegal for landlords to inquire about a potential renter’s immigration status or deny them housing based on that status. The proposal also aims to prevent landlords from retaliating against tenants who request repairs or complain about issues like mold by threatening to disclose their immigration status to federal authorities. This bill would align Oregon with at least four other states that have similar laws in place.
The bill would allow alternative forms of identification for rental applications, such as Individual Taxpayer Identification Numbers or driver’s licenses, for immigrants who may not have traditional forms of identification like birth certificates or Social Security numbers. An amendment does allow landlords to inquire about immigration status if required by a federal low-income housing program.
Supported by 17 Democratic senators and representatives, the bill is the top priority for the Legislature’s Black, Indigenous, People of Color Caucus. It has garnered support from advocacy groups, religious organizations, and labor unions. However, there is opposition from individuals concerned about landlord rights, housing competition, and prioritizing immigrant protections over citizen rent reductions.
Supporters of the bill argue that everyone, regardless of immigration status, deserves a safe and stable home. Undocumented immigrants are highlighted as valuable contributors to the economy who face discrimination when seeking housing. Opponents argue that landlords have the right to ask questions and vet renters, including determining legal status. The bill sponsors hope it will send a message that all families, regardless of origin, deserve a basic human right – a secure home.
